​Welcome to ERA Fitness! These Terms and Conditions govern your use of our website, services, and programs. By accessing or using ERA Fitness, you agree to comply with these terms. If you do not agree, please refrain from using our services.

​1. GENERAL TERMS

ERA Fitness provides online fitness coaching, workout plans, and basic nutritional guidance.

You must be at least 18 years old to use our services.

By using our services, you confirm that you are in good health and physically able to participate in fitness activities.

​2. MEDICAL DISCLAIMER & INDEMNITY WAIVER
The content provided by ERA Fitness is for informational purposes only, and does not constitute medical advice, diagnosis or treatment. It is the responsibility of the client to consult with a qualified healthcare provider before beginning any fitness or nutrition program, especially if they have a pre-existing medical condition, injury, or concern.

By participating in any coaching, training programs, advice, or services provided by ERA Fitness, the client agrees to assume full responsibility for their health, actions, and outcomes. ERA Fitness, its owner Julia Richards, and any associated parties shall not be held liable for any injury, loss, or damage resulting from participation in the program.
The client agrees to indemnify and hold harmless ERA Fitness, its coaches, contractors, and affiliates from any claims, damages, liabilities, costs, or expenses (including legal fees) arising out of or related to their participation in the coaching program, including but not limited to:

Misuse or misapplication of any program content.

Injury or health complications.

Failure to follow the recommended guidance or disclose relevant medical information.

Use of third-party platforms or services recommended by ERA Fitness.

​3. PAYMENTS & SUBSCRIPTIONS

Payments for coaching plans and subscriptions must be made in advance. If payment is not received on time, access to the program will be terminated.

Payments are paid monthly, unless otherwise specified.

Auto-renewal: Subscription plans renew automatically unless notice of cancellation is given.

We use the secure third-party payment processor Stripe and do not store any credit card information.

​4. REFUND & CANCELLATION POLICY

No Refunds: Due to the digital nature of our services, all purchases are final.

For all rolling memberships an initial commitment of three months must be made before cancellation.

You must give notice to cancel your subscription at least two weeks before the next payment is due. Access will remain active until the end of the notice period.

Subscriptions cannot be frozen.

5. INTELLECTUAL PROPERTY

All content, including workouts and guides, is owned by ERA Fitness and protected by copyright laws.

You cannot redistribute, copy, or resell any materials without prior written consent.
6. USER CONDUCT

You agree not to misuse our website or services.

Harassment, hate speech, or inappropriate conduct towards ERA Fitness coaches or community members will result in termination of access.

7. COMMUNICATION

Communication will be via the Everfit app messaging feature.

Messages will be responded to in business hours Monday - Friday.
​8. PRIVACY & USE OF THIRD-PARTY PLATFORMS
We collect and store personal data in accordance with our Privacy Policy.

To deliver coaching services, track client progress, and manage communication, we use a third-party platform called Everfit. As part of using our services, your personal information—including progress photos, training data, and communication—may be stored or processed through Everfit.

Everfit has its own privacy practices, which are separate from ours. We encourage you to review their Privacy Policy to understand how your data is managed and protected by their platform: https://everfit.io/privacy

While we take reasonable steps to protect your personal information, by using our services, you acknowledge and agree that some of your data will be handled by Everfit according to their terms.​

9. MODIFICATIONS TO TERMS

ERA Fitness reserves the right to update these Terms & Conditions at any time.

Continued use of our services constitutes acceptance of any changes.
